I know eBay tries to be on top of counterfeits...but you're right, you don't really know what you're getting. I'd check the seller's history, rating and where the product is coming from and I'd probably pass on anything that seems a little too good to be true.
Other stores you may try are Moosejaw (they often have some good deals/coupons) and REI. They often have North Face sales. Your best bet may be to find a good store coupon and work backwards.
Oh, and one other option...try craiglists...sometimes people sell new ones there (or so they say). And you can probably at least get a look at the item without having to pay first.
